Outland Spousal Sponsorship + Visitor Visa Options

A spouse or partner outside Canada may apply for a visitor visa while a Family Class sponsorship application is in process. A visitor visa is a separate temporary-residence application and must meet its own eligibility requirements.

Faster processing may be available after AOR. If the sponsor has received an acknowledgement of receipt confirming that the spouse or partner's permanent residence application is in process, IRCC says the spouse or partner may be eligible for faster visitor-visa processing. They must include the AOR and still meet all visitor-visa requirements. If eligible, the faster processing is automatic; there is no separate “priority visitor visa” category to purchase or request.

Spousal Sponsorship

  • The sponsor and applicant must meet the Family Class requirements.
  • The relationship must be genuine and not entered into mainly for immigration purposes.
  • The PR application and visitor-visa application are assessed separately.

Visitor Visa

  • The applicant needs a valid travel document and must be admissible.
  • They must satisfy IRCC that their stay will be temporary if PR is not approved.
  • They must show sufficient funds and meet the other visitor requirements.
1. Submit Sponsorship File the complete spouse/partner PR application.
2. Receive AOR IRCC confirms the PR application is in process.
3. Apply for TRV Include AOR and evidence meeting visitor requirements.
4. If Approved The spouse/partner may travel to Canada subject to border examination.
Dual intent is recognized in Canadian immigration law. A person may genuinely intend to become a permanent resident in the future while also seeking temporary entry. The key issue is whether they will respect the conditions of temporary status if permanent residence is not granted.
Visitor visa approval is never guaranteed. A pending sponsorship application, marriage to a Canadian or an AOR does not by itself create a right to enter Canada. The border services officer also makes the final entry decision when the traveller arrives.

After Arrival in Canada

If the spouse or partner is living in Canada with the sponsor and the sponsor has received an AOR, they may be eligible to apply for an open work permit under the current IRCC spousal sponsorship rules.

Keep Temporary Status Valid

A visitor must continue to maintain valid temporary resident status while in Canada. A visitor visa is a travel document; it is not the same as visitor status or a visitor record.
